This is Example 1 of grounds for an appeal that I prepared to challenge CBP’s official answer for an examinee who initially failed the U.S. Customs Broker License Exam, but passed on appeal.

OCTOBER 2019 Test, Question 13
13. The carrier, importer, or broker must present all required information to CBP by means of a CBP-approved electronic data interchange system no later than ____________ prior to the carrier’s reaching the first port of arrival in the United States.
A. The scheduled date or time of arrival of the truck
B. Either 30 minutes or 1 hour
C. 5 working days in advance of the arrival of the first conveyance
D. 15 calendar days after landing from a vessel, aircraft or vehicle, or after arrival at the port of destination
E. Within 30 days

CBP’s official answer is B – Either 30 minutes or 1 hour.

APPEAL ARGUMENT

Question 13 does not specify the mode of transport – by truck, air, rail or sea. Answer choice B pertains to advance electronic intimation of cargo information for truck cargo. As the question does not specify that it pertains to truck cargo, there is insufficient information in the question to pick choice B. Due to the erroneously drafted question with incomplete information, it is not possible to answer this question correctly with the given information. Therefore, credit should be given to all candidates who attempted but failed to answer it correctly and appealed this question.
